NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF ROLL AND BALANCE INC., D/B/A NOVA TENNIS ACADEMY, USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM ROLL AND BALANCE INC., D/B/A NOVA TENNIS ACADEMY, IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND ROLL AND BALANCE INC., D/B/A NOVA TENNIS ACADEMY, HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
1. Assumption of Risk & Release of Liability
I, the undersigned parent or legal guardian, acknowledge and agree to the following on behalf of myself and the minor child named above:
Assumption of Risk. I understand that tennis, pickleball, and related physical conditioning activities involve inherent risks, whether known or unknown, including but not limited to: slips, falls, and collisions with other participants, equipment, or fixed objects; being struck by a ball, racket, or other equipment; muscle strains, sprains, fractures, and joint injuries; heat exhaustion, heat stroke, and dehydration; insect bites and stings and exposure to sun and weather; the negligent or intentional acts of other participants; and court, park, and facility surface conditions typical of outdoor public recreational venues. I voluntarily assume all such risks, known and unknown, on behalf of myself and my child.
Release of Liability. To the fullest extent permitted by Florida law, including but not limited to section 744.301(3), Florida Statutes, I release, waive, and discharge Roll and Balance Inc., d/b/a Nova Tennis Academy, its owners, officers, coaches, employees, contractors, and agents, and the city, municipality, or park authority where the program is held (the "Released Parties"), from any and all claims, demands, or causes of action arising from my child's participation, to the extent such claims result from an inherent risk of the activity as defined by Florida law.
Indemnification. I personally agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, judgments, losses, costs, and attorney's fees arising out of or related to my child's participation, including claims brought by or on behalf of my child, to the fullest extent permitted by law.
Lost or Damaged Property. Nova Tennis Academy is not responsible for lost, stolen, or damaged personal property, including rackets, phones, clothing, or other belongings left at the facility.
2. Medical Authorization
A. Physical Fitness. I certify that my child is physically fit to participate in the program.
B. Emergency Treatment, First Aid & Hospitalization. I authorize Nova Tennis Academy staff and coaches, in their reasonable judgment, to administer basic first aid, call 911 or other emergency services, and consent to emergency medical treatment and hospitalization for my child if I cannot immediately be reached or if a coach determines immediate action is necessary. I accept full financial responsibility for any such treatment and confirm that my child is covered by my own health insurance, which I agree to maintain throughout participation in Academy programs.
C. Medication. If my child has a known medical condition requiring medication (such as asthma, severe allergies, or diabetes), I will ensure necessary medication is physically with my child or in their bag at all times. Staff are not responsible for storing or administering medication.
D. Sun and Insect Protection. I authorize Nova Tennis Academy staff to assist my child in applying sunscreen or insect repellent when needed, and confirm I have disclosed any known product allergies above.
3. Safety, Supervision & Transportation Policy
Drop-off and Pick-up. I agree to personally escort my child to the court and hand them directly to a coach, and to be present before the session ends to pick them up. Waiting in a vehicle in the parking lot is not permitted. Nova Tennis Academy is not responsible for a child walking unaccompanied through a parking lot or park to reach a vehicle.
I understand that coaches supervise children only within the fenced court area in use. Whenever I am present at the facility, I agree to personally escort my child to the restroom or water fountain myself, to remain reachable by phone during the session, and to respond promptly to any call from Academy staff regarding my child. If my child needs to use a restroom or water fountain and I am not present at the facility, I authorize Academy staff to allow my child to walk unaccompanied to the nearest public restroom or water fountain. Academy staff will not enter a restroom with my child under any circumstance.
Leaving the Court Area. Coaches supervise children only within the boundaries of the court in use. If my child leaves this area without a parent present, Nova Tennis Academy is not liable for any incident occurring outside the court boundaries.
Weather Cancellations. If a session is stopped due to rain, lightning, or other weather conditions, I understand I must take immediate custody of my child.
4. Required Equipment
I agree to send my child to each session with: non-marking tennis-appropriate shoes; appropriate athletic clothing including a hat or visor; a personal water bottle; and an appropriately sized racket. A coach may remove my child from a session without refund if they arrive without required footwear or safety equipment.
5. Physical Contact During Instruction
I understand that coaching may involve a coach making appropriate physical contact with my child — for example, adjusting a grip, arm position, or stance — solely for instructional purposes, and I consent to such contact.
6. Media Release
Nova Tennis Academy regularly photographs and films classes for its website, social media, and promotional materials. This section is a separate choice — it is not required to enroll.
This box is checked by default. If you do not want your child's photo or video used, simply uncheck it — your choice is recorded either way and does not affect enrollment.
7. Code of Conduct
I agree that my child will treat coaches, staff, and other participants with respect, and will not engage in bullying, harassment, discriminatory language or behavior, physical aggression, aggressive disputes over line calls or tournament/league rules, or other unsportsmanlike conduct. I understand that Nova Tennis Academy may disqualify or remove my child from a session, match, league, or tournament, or terminate participation in the program entirely, without refund, for a violation of this Code of Conduct, at the Academy's sole discretion.
8. Communications Consent
I consent to receive transactional and scheduling communications from Nova Tennis Academy by email, SMS/text message, and phone call — including automated messages — at the phone number(s) and email provided above, regarding scheduling, billing, and program updates. This consent is a condition of participation.
By providing my phone number, I additionally opt in to receive promotional and marketing SMS messages from Nova Tennis Academy. I understand that this specific promotional consent is not a condition of participation, and that I may decline it or opt out at any time by replying STOP, without affecting my enrollment. Message and data rates may apply. My information will not be sold to third parties and will be used solely for Academy business purposes, consistent with the Academy's Privacy Policy at nova-tennis-academy.com.
9. Data Processing Consent
I consent to the collection, storage, and use of the personal data provided in this form for registration, safety, communication, and administrative purposes by Nova Tennis Academy.
10. Payment Policy
Class Passes & Subscription Types.
- Single-Class Pass: valid for one (1) class, usable within 30 days of the purchase date.
- Monthly Subscription: grants access to classes one, two, or three times per week (as selected at enrollment) for one billing cycle running from the 1st to the 1st of the following month. This is a subscription to a weekly schedule, not a fixed number of total sessions.
- Quarterly, Semi-Annual, and Annual Subscriptions: grant access to the same weekly class schedule selected at enrollment, automatically renewed and charged at the start of each billing period for the length of the term.
- Ongoing (Month-to-Month) Subscription: renews automatically every month with no fixed end date, for as long as it remains active.
Automatic Renewal & Billing Date. All subscription payments are automatically charged on the last day of the current month, for the following month's classes, unless I have cancelled my subscription before that date in accordance with the cancellation terms below. A one-time Annual Registration Fee of $100 is charged once per year for all active participants. All fees are non-refundable except as expressly stated in this section.
Automatic Payment Authorization. By providing a payment method, I authorize Nova Tennis Academy and its designated third-party payment processor to automatically charge that payment method on a recurring basis, according to the schedule of my selected subscription, until my subscription is cancelled in accordance with this agreement. I am responsible for keeping my payment method current and valid, and for the consequences of a declined or failed payment.
Missed Classes & Make-Ups. If a participant simply does not attend a scheduled class, that class is forfeited — it is not banked, credited, or eligible for a make-up. A missed class is eligible for a make-up ONLY in one of the following two cases: (1) illness, supported by a doctor's note confirming the participant was unable to attend, or (2) a class cancelled by the Academy due to weather conditions. When a make-up is authorized, Nova Tennis Academy will designate a specific date for a make-up class. Only the participant who missed the original class may attend the designated make-up; attendance may not be substituted by a sibling, parent, or other family member. If the number of documented weather- or illness-related absences makes a make-up class impractical, Nova Tennis Academy may, at its sole discretion, instead offer a discount toward the next subscription in lieu of a make-up class.
Cancellation of Quarterly, Semi-Annual, and Annual Subscriptions. These subscriptions may not be cancelled before the end of their selected term except in one of the following circumstances: (1) a doctor's note confirming the participant is medically unable to participate in sports activity for a period of three months or more; or (2) the participant's household has relocated more than 25 miles from every Nova Tennis Academy location, supported by proof of the new address (such as a driver's license or a utility bill).
Cancellation of Monthly / Ongoing Subscriptions. To cancel a Monthly or Ongoing subscription and stop the next automatic payment, I must notify Nova Tennis Academy in writing, by email to the Academy's official email address, before the last day of the current month (the automatic billing date for next month). If an automatic payment fails for an Ongoing subscription, that subscription is automatically cancelled.
No Refunds. Payments already made are final and non-refundable — this applies to unused classes, cancelled subscriptions (except the early-cancellation terms above), and removal from the program due to a Code of Conduct violation or failure to bring required equipment.
11. Governing Law & Severability
This agreement is governed by the laws of the State of Florida. If any provision is found unenforceable, all remaining provisions remain in full force and effect.
